All capitalized terms not otherwise defined in these Rules and Regulations shall have the same meaning as in the Storage Agreement.
1. The following are prohibited in the Slip or upon the Marina premises and may result in immediate termination of the storage Agreement:
a) The use of abusive or foul language towards another customer, guest, or Marina staff
b) Use of barbecues, welding equipment, burning torches or any other open flame apparatus
c) Fueling from portable containers
d) Gambling or any other illegal activity or nuisance
e) Intentional discharge of a firearm
f) Fireworks or explosives of any kind
g) Allowing the rental of Customer’s boat or assigned Slip to provide a timeshare or shared ownership such as, but not limited to AIRBNB or VRBO-type service of any kind
h) “Live a boards” (defined as a vessel on which one or more people live for more than 14 or more consecutive days)
i) Removal or disturbance of any historical, archaeological or other cultural artifacts, relics, remains or objects of antiquity
j) Wading, swimming, or bathing within 100 feet of the docks
2. Customer shall not throw, deposit, discharge, pump or otherwise place any refuse, garbage, debris, oil, spirits, paint, sewage, flammable material, or any other pollutants of any description upon the floats or water of the Marina. Any governmental fines, including the cost of cleanup, resulting from the actions of the Customer shall be the sole responsibility of the Customer. Oil is to be deposited in the oil waste container at the Service and Sales building. Waste oil is not to be placed in or beside the garbage dumpsters or spilled in the Marina waterways. Docks shall be kept clean from grease, oil, spray paints or any other staining material. Customer shall be responsible for all clean-up costs.
3. While inside the Marina or in the channel leading to the Marina beginning at the breakwater, Customer’s Vessel shall not create a wake. Maximum speed in the Marina and channel is four knots or no wake, whichever occurs first.
4. No part of any vessel may extend over the main walkways. All boats shall be moored in a safe and secure manner on cleats with strong mooring lines. In the event the Operator deems the Customer’s mooring lines to be unsafe, the Operator may (but shall not be required to) replace such lines and the Customer shall be responsible to pay all associated costs.
5. Chafing gear and dock boxes shall not be attached to the docks. Only dock boxes obtained from the Marina may be used. Dock boxes are available for rent and are the property of the Marina. Construction of any kind or to the docks is prohibited. The Marina reserves the right to remove, add, or adapt any existing construction, addition, or modification made to any portion of the docks, not limited to, but including dinghy racks, dock boxes, and stairs.
6. Customers are prohibited from making any noise between the hours of 9 pm and 7 am (or as otherwise required by county or city ordinance) that substantially interferes with the comfortable enjoyment of persons of ordinary sensibilities occupying, owning, or controlling nearby properties or of persons making use of public properties for their intended purposes.
7. Water, electrical cords, or mooring lines shall not be placed across the walkways. All electrical cords must be marine grade and have a plug with a watertight seal. No gear of any kind shall be stored on the dock unless in an approved dock box.
8. Customer shall not prop the gate open for any reason. All guests must be accompanied by the Customer.
9. Customers vehicles are required to display a parking pass when entering or remaining on Marina property. Passes are available in the office. The speed limit in all parking areas is 10 mph.
10. The Vessel shall be stored in the water within the Customer’s Slip, unless otherwise approved by the Marina.
11. Customer shall be responsible for accompanying minors, incompetents, and infirmed guests of theirs at the Marina. Children must wear life jackets while on or around dock area as prescribed by law as if they were aboard a vessel.
12. Pets shall always be leashed when on Marina’s premises. Pet owners are responsible to clean up after their animals and dispose of excrement in a proper container.
13. Any work to be performed by a third-party vendor shall require approval in advance by Marina Operator. The Marina will always exercise control over whether to allow third-party including vendors to enter the Marina. Third-party vendors must complete the Operator’s Sub-Contractor Information Form and Agreement available at https://hipaa.jotform.com/211655008782052. A list of pre-approved vendors may be available upon request.
14. Auxiliary motors on sailing vessels must be used within the Marina; sailing within the Marina is prohibited. Sailing vessels without auxiliary power must arrange for towing while within the Marina.
15. Garbage and recycling cans owned by the Marina are for vessel garbage only and not for household use. Cardboard must be broken down and placed in the breezeway near the office.
16. All docks and fingers piers must always be kept clear to permit easy access by emergency crews and their equipment. The Marina reserves the right to confiscate any items left on the docks and finger piers at any time and to store or dispose of these items at its discretion and Customer will be responsible for any cost associated with the storage or disposal.
17. Lot access. The equipment operator’s vision is limited under use. Customer is not permitted to enter the storage area during operating hours without prior written consent from the Operator.
18. Storage and launching vessel. Customer must notify Operator two hours prior to the time in which they would like their Vessel available. If Customer would like the Vessel available before 11:00 am notification must be delivered the previous day during operating hours. The following equipment must be stored on the vessel in an easily accessible location, and the equipment must be in good usable condition.
a) Four (4) lines for mooring and boat handling
b) Two (2) fenders equipped with line and fasteners
c) Minimum of one (1) life vest must be stored in the vessel along with one (1) number four throw-able
d) One (1) paddle or oar
All vessels must be equipped with an onboard battery switch. If Customer drops the vessel off for storage and the vessel is not equipped with a battery switch the Operator will install and appropriate charge the Customer for parts and labor at the advertised labor rate.
If a customer plans to vacate an assigned slip for more than 24 hours, all dock lines must be removed.
19. Recovering vessel. Customer must moor vessel on the Operator’s dock when returning the vessel for storage. Customer should place vessel keys in the designated key drop location in order for Operator to recover the vessel for storage. Vessels returned after the posted business hours for the marina will be recovered and stored the following day. All antennas, outriggers, tops and biminis must be lowered and placed in the stored position. Failure to properly secure and store said items will result in an add $10.00 service charge for each occurrence. The battery switch must be placed in the “off” position. Jump starts due to failed operation of a battery switch will incur a $5.00 service charge for each occurrence. All vessels must be equipped with an automatic bilge pump. If Customer drops the vessel off for storage and the vessel is not equipped with automatic bilge pump the Operator will install and appropriately charge the Customer for parts and labor at the advertised labor rate.
20. Construction and development. The Marina may go through heavy construction and development from time to time. It is possible that CUSTOMER may have limited access to his or her Vessel during these periods of time. CUSTOMER recognizes that he or she has performed due diligence to fully understand the future development that may cause limited access along with other possible inconveniences. Under no circumstances will the CUSTOMER be refunded or reimbursed for rent based on said development.
21. Electricity (Clemson Marina only). Electricity is available for limited (short term) supply only (for example to run a vacuum, pressure washer or to charge vessels batteries). All long-term electrical use must be metered. Electricity is billed monthly for the electricity used in the previous month. A monthly reading/facilitation fee in the amount of $5 per month will be charged to slips that need metered electricity regardless of the amount used even if there was no usage during the month.
22. The Marina Rules and Regulations summarized herein and as amended from time to time and all other policies and regulations established by Governmental Entities are part of the storage Agreement as if set forth fully therein.
